The Agent acknowledges and explicitly agrees that by completing this market appraisal AMG will hold, retain and otherwise process the details of the Agent including those of its employees, representatives or agents in electronic and/or written form for legal, administrative or management purposes and may provide those details to a landlord, any legal adviser, tenant, or other relevant third party including an ombudsman or regulator and that those details may constitute personal data including DBS checks for criminal convictions in order to comply with certain legal requirements.

The Agent agrees and confirms that it has in place appropriate technical or organisational measures to protect against unauthorised or unlawful processing of personal data and against accidental loss, destruction or damage to personal data appropriate to the harm that might result from the unauthorised or unlawful processing or accidental loss, destruction or damage and the nature of the data to be protected having regard to the technology and the cost of implementing measures including:

2.1 anonymisation and/or encryption of the data;

2.2 ensuring confidentiality, integrity and resilience of its computer systems;

2.3 ensuring the availability of and access to personal data including the ability to restore personal data after an incident;

2.4 regularly assessing and revising (where appropriate) the effectiveness of the technical and organisational measures adopted.

The Agent agrees and undertakes (a) to treat as confidential and (b) not to re-use any information or data he/she/it obtains in the course of this appointment about AMG’s clients, customers or employees (including in any case former clients, customers or employees) save except for the purpose of carrying out this appointment or engagement.

The Agent shall notify AMG of any actual or suspected data breach immediately and in any event within 24 hours of the Agent acquiring the knowledge of an actual or suspected data breach.

The Agent agrees that it shall indemnify and hold harmless AMG against any breach of
these clauses (1) to (5) including any breach generally of the GDPR or the DPA.
